a.       The HOT 95-7 American Idol Giveaway (the “Contest”) will begin on Tuesday, May 13, 2008 at approximately 7 p.m. Central Time (“CT”) and end on Thursday, May 15, 2008 at approximately 11:59 p.m. CT (the “Contest Period”).

 

b.      To participate in the Contest, listeners will need to listen to HOT 95-7 KKHH (the “Station”) during the Contest Period. When the DJ/On-air talent cues the listeners to text in, there are two ways listeners may enter the Contest:

 

·        Text the keyword “Idol” to 43952 after hearing the cue to text. Standard text messaging fees may apply and the Station is not responsible for any fees incurred by a participant using this method of entry. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions or any other technological difficulties that may prevent an individual from completing his or her telephone call.

 

a.       The Contest is open to all KKHH listeners who are 18 years of age or older and who reside in the greater Houston metropolitan area. Employees of KKHH, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Houston metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.

 

b.      Listeners are eligible to win a KKHH prize valued at $600 or more only once every six (6) months. 

 

c.       Winners will be required to sign a liability and publicity release and show a valid government- issued photo identification card to claim prize.  If winner is under the age of 18, that winner’s parent or guardian will be required to sign a liability and publicity release and show a valid government issued photo identification card to claim prize.

 

d.      Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

 

a.       Total number of daily prizes is ten (10).  Each daily prize winner will receive one (1) copy of the “American Idol: Season 6 Finale Performance Show” on DVD. Approximate retail value of each prize: $19.99.

 

b.      One Grand Prize winner will receive a trip for two to see an American Idol taping in Los Angeles.  Trip must be taken May 19 – 21, 2008.  Trip includes round trip coach airfare from Houston to Los Angeles, Two nights lodging and two tickets to the American Idol taping on May 20, 2008. Travel companions of winner must travel with the winner on the same travel itinerary. Winner and travel companion are solely responsible for obtaining travel insurance (and all forms of insurance) where applicable, at their option, and hereby acknowledge that the Station has not and will not obtain or provide travel insurance or any other form of insurance. Any winners of the certificates/vouchers will be subject to the terms and conditions as set forth by the provider of the certificate/voucher.   Winner and travel companion are solely responsible of all applicable taxes including but not limited to hotel, hospitality and airport taxes, departure taxes, telephone charge, meals, gratuities, ground transportation and any other expenses not specifically offered herein. Winner may be required to present a valid credit card upon hotel check-in to cover incidental expenses incurred during stay. Other restrictions may apply. All travelers must possess required travel documents. (e.g. valid photo I.D.) prior to departure. Approximate value: $2,000

 

c.       All prizes or prize certificates may be picked up at the office of KKHH, 24 Greenway Plaza, Suite 1900, Houston, TX 77046. Any prize or prize certificate not claimed within thirty (30) days of winning will be forfeited by the winner. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. KKHH is not responsible for the safe arrival of a prize or prize certificate.

 

d.      There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, solely at its discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the items above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

a.       Decisions of KKHH management with respect to the Contest are final.

 

b.      Ten (10) daily prize winners will be selected as described in section 1 of these official Contest rules by being the 95^th texter or web entrant.

 

c.       One grand prize winner will be selected by random drawing from all daily prize winners.   Drawing will be on May 16 at approximately 9 AM. 

 

d.      Odds of winning will depend on number and order of text messages and online entries received.

 

e.       Winners must listen to win, but do not need to be present to win.

 

f.        Daily winners will be notified that they have won by a text message. Winners will then be notified by phone on procedures to pick up their prizes. Winner(s) will be instructed to come to the KKHH offices to pick up their prize within 30 days or the prize will be forfeited.   If the winner entered via the web site they will be notified by phone.   Grand prize winner will be notified by phone. If winner can not be reached within two hours of winning, winner will forfeit prize and another winner will be randomly selected. 

a.       Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

 

b.      By participating in the Contest, the winner or winners (and their guest or traveling companion, if any) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

 

c.       Prior to awarding any prize or prize certificate, KKHH  in its sole discretion may require Contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.

 

d.      The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s Web Site or is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the Contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

 

e.       KKHH reserves the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement.

 

f.        Failure to comply with the Contest rules may result in a contestant's disqualification, solely at the discretion of KKHH.

 

g.       KKHH is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.

 

h.       Copies of the written Contest rules and a list of all winners are available (when complete) during regular business hours at the main studio of KKHH, 24 Greenway Plaza, Suite 1900, Houston, TX 77046 or by sending a self-addressed stamped envelope to KKHH.
